Cancellation & Refund Policy

1. Seller and scope

This policy applies to purchases made on englishsmart.org, operated by PROTRAD & TRAINING S.R.L.,CUI 47879810, Trade Register number J2023002028238, with its registered office at Str. Studioului nr. 20, Buftea, Ilfov County, Romania.

PROTRAD & TRAINING S.R.L. is the direct seller, provides the purchased access, and issues the corresponding invoices.

2. What you purchase

A subscription provides time-limited access to the interactive English practice tests included in your
selected plan. Tests are accessed and completed online. We do not supply physical products. There are no physical
items to return or return shipping costs. Cancellation and refund requests concern your purchased access plan.

3. Subscription expiry

Access plans are purchased for a fixed period and do not renew automatically. Access expires at the end of the
purchased period unless you make a new purchase.

You do not need to request cancellation to prevent renewal. Choosing to stop using a plan does not, by itself, create
a right to a refund.

4. Statutory right of withdrawal

If you purchase as a consumer, you generally have the right to withdraw from an online contract within 14 days of its
conclusion without giving a reason, subject to the exceptions and conditions established by applicable law.

To meet the withdrawal deadline, you must send your withdrawal notice before the applicable period expires. You do not need to wait for our reply.

Access supplied during the withdrawal period

For a contract legally classified as a service, where you expressly request that performance begin during the
withdrawal period and we have provided the legally required information, you may be required to pay a proportionate
amount for the service supplied up to the time you notify us of your withdrawal.

Any such amount will be calculated in accordance with applicable law, based on the agreed total price and the
service actually supplied. We will explain any deduction. No deduction will be made where the legal conditions
for charging that amount have not been met.

For digital content supplied without a physical medium, the right of withdrawal is lost when supply begins only
if all applicable legal conditions have been met: you have given prior express consent to supply during
the withdrawal period, acknowledged the resulting loss of your withdrawal right, and received the legally
required contract confirmation.

We do not treat payment, acceptance of general terms, or use of the Website alone as satisfying these conditions.
Any exception will be applied only where it is legally applicable to the purchased offer and the required
conditions have been fulfilled.

5. How to request withdrawal, cancellation, or a refund

Email support@englishsmart.org with a clear statement of your request. To help us identify your purchase, please include:

• Your name
• The email address associated with your account
• Your order reference or purchase date, if available
• The access plan concerned

No particular wording or explanation is required to exercise a statutory right of withdrawal.
Missing an order reference does not invalidate a clear withdrawal notice.

We will acknowledge your request and explain the applicable outcome, including any lawful deduction or the reason
a refund is not due.

6. Refund method and timing

For a valid statutory withdrawal, we will reimburse the amount due without undue delay and no later than
14 days after receiving your withdrawal notice. Any legally payable amount for services already supplied
may be deducted as explained above.

Refunds will be made using the same payment method as the original transaction, unless you expressly agree
to another method. We do not charge a refund fee. Card payment refunds are returned to the card used
for the purchase through the payment processor.

Your bank or payment provider may require additional processing time before the refund appears in your account.
This does not extend our legal reimbursement deadline.

7. Access following withdrawal or termination

When the contract is withdrawn from or terminated, your entitlement to use the access covered by that
contract ends, and we will deactivate that access. You must stop using the affected paid content.

A delay in our administrative processing will not increase any proportionate charge beyond the amount lawfully due
at the time you notified us of withdrawal.

8. Technical problems and non-conforming access

If payment has been confirmed but access is unavailable, or the purchased tests do not function or match their
description, contact support@englishsmart.org. Please describe the problem and, where useful, provide
a screenshot without sensitive payment information.

We will investigate and provide the remedies required by applicable law. Depending on the circumstances,
these may include supplying or restoring access, bringing the content or service into conformity,
a proportionate price reduction, or termination and reimbursement.

These rights are separate from the right to withdraw because you have changed your mind. They are not
automatically lost after 14 days or when you begin using the tests. Refunds under these rights will be
made within the applicable statutory deadline.
