Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of www.englishsmart.org (the “Website”), including purchases of digital products, access plans, educational materials, and related services.

Please read these Terms before creating an account or making a purchase. Nothing in these Terms excludes or limits mandatory consumer rights under applicable law.

1. Who we are and our role

EnglishSmart is an independent educational platform operated by PROTRAD & TRAINING S.R.L., a company registered in Romania.

PROTRAD & TRAINING S.R.L. is the direct seller and provider of the digital products and services offered on this Website. It is the contracting party for customer purchases, provides the purchased access, and issues the corresponding invoices.

EnglishSmart is the platform name under which these products and services are offered. The Website does not operate as a marketplace or as an intermediary selling on behalf of third-party sellers.

Card payments are processed through NETOPIA Payments. The payment processor facilitates payment processing; the seller and invoice issuer remains PROTRAD & TRAINING S.R.L.

EnglishSmart is not affiliated with or endorsed by Cambridge University Press & Assessment, Cambridge English, the University of Cambridge, or related entities.

2. Products and services

EnglishSmart provides paid, time-limited access to interactive
English practice tests completed online through the Website.
Purchasing an access plan allows you to use the tests included
in that plan for the stated access period.

No physical products are sold or shipped. There are no physical
items to return. Cancellation and refund requests concern
the purchased access plan.

The price, duration, and tests included in each plan are
displayed before purchase.

3. Educational purpose

Our resources are intended for learning and practice. They do not constitute official examination materials, accreditation, or a guarantee of any examination result.

Purchasing access does not include registration for an official examination or an official language qualification.

4. Independent materials

Materials presented as EnglishSmart resources are independently created practice materials. They are not official Cambridge examination papers, past papers, or endorsed content.

5. Eligibility and use by children

Purchases must be made by an adult with legal capacity to enter into a contract, or by a person otherwise authorised under applicable law.

Where resources are used by children, a parent, legal guardian, or authorised educator should supervise their use as appropriate. Adults making purchases for children are responsible for selecting a suitable product and managing the purchase.

6. User accounts

Some products and services require a user account. You must:

  • Provide accurate account and billing information
  • Keep your login credentials confidential
  • Use your account within the limits of the purchased plan
  • Avoid sharing access unless expressly permitted
  • Notify us promptly of suspected unauthorised account use

You are responsible for your use of the account. This does not make you responsible for security incidents attributable to us.

7. Free access and paid access plans

  • A 48-hour free access period may be available where expressly stated in the relevant offer.
  • No payment is charged for the stated free access period.
  • After free access expires, continued access to paid resources requires a separate purchase.
  • Paid plans may include access for 1, 3, or 6 months, depending on the offer selected.
  • The duration and included resources are those specified in the purchased offer.
  • Paid plans do not renew automatically. A new purchase is required to continue after expiry.
  • Access is personal and non-transferable unless the purchased licence expressly permits otherwise.

8. Prices, payments, and invoices

PROTRAD & TRAINING S.R.L. is not registered for VAT in Romania. The total price and payment currency are displayed before you place your order.

Card payments are processed through NETOPIA Payments using the payment options available at checkout. Access to paid products is subject to successful payment confirmation.

PROTRAD & TRAINING S.R.L. issues the corresponding invoices using the billing details provided by the customer and in accordance with applicable invoicing requirements.

Prices may change for future purchases. Such changes do not alter the price of a purchase already concluded.

If you notice a payment error or a duplicate charge, please contact support@englishsmart.org with the relevant order information. Do not send full card details or card security codes.

9. Digital access and withdrawal rights

Digital products and services are provided through the Website and, where applicable, your user account. Access may begin after successful payment confirmation, as described in the relevant purchase information.

If your payment has been confirmed but the purchased access is unavailable, please contact support@englishsmart.org with your order reference.

Consumers generally have a statutory 14-day right of withdrawal from a distance contract, subject to the conditions and exceptions provided by applicable law.

For digital content supplied without a physical medium, the right of withdrawal may be lost once supply begins only where all applicable legal conditions have been met. These include your prior express consent to supply during the withdrawal period, your acknowledgement that you thereby lose your right of withdrawal, and the required confirmation of the contract.

Acceptance of these Terms alone does not constitute that express consent or acknowledgement. Where required, these will be requested separately during the purchase process.

Where an offer qualifies as a digital service, the applicable rules for services govern withdrawal and any amount lawfully payable for performance requested during the withdrawal period.

To notify us of a withdrawal or request a cancellation or refund, email support@englishsmart.org with a clear statement of your request and sufficient information to identify your purchase, such as your order reference and account email. No particular wording is required to exercise a statutory right of withdrawal.

Where a refund is due following a valid statutory withdrawal, we will reimburse the applicable amount without undue delay and no later than 14 days after we are informed of your decision. We will use the same payment method as the original transaction, unless you expressly agree otherwise, without charging reimbursement fees.

Any withdrawal exception does not affect your statutory remedies if digital content or services are not supplied or do not conform to the contract.

10. Acceptable use

You must not:

  • Use the Website for unlawful or fraudulent purposes
  • Resell or redistribute materials without permission
  • Share paid access beyond the purchased licence
  • Bypass payment requirements or access restrictions
  • Interfere with the Website or its security
  • Impersonate another person or entity
  • Use the Website to harm or harass others
  • Present EnglishSmart resources as official Cambridge materials or endorsed content

11. Intellectual property and permitted use

Website content is owned by PROTRAD & TRAINING S.R.L. or used under permission or licence from the relevant rights holders.

Your purchase grants a limited right to use the included resources for the purpose and duration stated in the offer. It does not transfer ownership of intellectual property.

You may use resources for personal study. Classroom or other educational use is permitted only to the extent allowed by the relevant product or licence.

Unless permitted by law or expressly authorised, you must not:

  • Resell or redistribute the content
  • Upload materials to publicly accessible platforms
  • Remove copyright notices or branding
  • Create commercial derivative products from the materials
  • Copy the materials for a competing service

12. Third-party trademarks

Third-party names and trademarks belong to their respective owners. References are descriptive and do not imply affiliation, sponsorship, or endorsement.

13. Availability, technical requirements, and conformity

Use of the online resources requires an internet connection and a compatible device and browser. Any additional requirements or material compatibility limitations must be stated in the relevant offer before purchase.

Temporary interruptions may occur for maintenance or technical reasons. We will take reasonable steps to resolve issues and provide notice of planned interruptions where practicable.

We remain responsible for supplying purchased digital content and services in conformity with the contract and applicable law, including any legally required updates.

If a resource is unavailable, defective, or materially different from its description, contact support@englishsmart.org. Depending on the circumstances, statutory remedies may include bringing it into conformity, a price reduction, or termination and reimbursement.

14. Learning outcomes

Learning progress depends on factors including prior knowledge, practice, and individual circumstances. We do not guarantee examination success, a particular score, or a specific improvement timeline.

This does not limit our obligation to provide the features and services expressly included in your purchase.

15. Third-party links and services

The Website may contain links to external websites or use third-party services. External websites may have their own terms and privacy policies.

We do not control independent external content. Our use of third-party providers does not remove our responsibility for fulfilling our contractual obligations to customers.

16. Liability

Each party is responsible for its obligations under the contract and applicable law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or restricts mandatory consumer rights and remedies.

17. Suspension and termination

We may restrict or suspend access where reasonably necessary to address a material breach of these Terms, fraud, a security threat, or non-payment for the relevant access.

Where appropriate, we will explain the reason and provide an opportunity to resolve the issue before suspension. Immediate action may be necessary to protect users, the Website, or comply with legal obligations.

Any restriction or termination will be proportionate to the circumstances and will respect applicable consumer rights. If we discontinue a purchased service, we will provide the remedies required by law for any unfulfilled obligations.

19. Changes to these Terms

We may update these Terms for future purchases and Website use. The Terms applicable to a purchase are those in effect when that purchase is concluded.

Updates will not retroactively remove rights arising from existing purchases. Any changes affecting an ongoing contract will be made only as permitted by law, with any required notice and consumer safeguards.

20. Applicable law and complaints

These Terms are governed by Romanian law. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law applicable to you.

You may also contact the Romanian National Authority for Consumer Protection (ANPC) or use any competent dispute resolution body or court available under applicable law. You are not required to waive these rights by contacting us.
